SAT Preparation Platform Terms and Conditions

1. Acceptance of Terms

By accessing or using this SAT preparation platform (the "Service"), you agree to these Terms and our Privacy Policy, which are incorporated by reference (together, the "Agreement"). If you do not agree, do not use the Service.If you use the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization, and "you" includes that organization.

2. Eligibility; Minors

You must be at least the age of majority in your jurisdiction to purchase a subscription.If you are under the age of majority, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms and is responsible for your use.

3. Changes to the Service and Terms

We may modify the Service, add or remove features, or suspend the Service at any time.We may update these Terms by posting an updated version and updating the "Last updated" date. If changes are material, we may provide additional notice. Continued use of the Service after changes take effect means you accept the updated Terms.Nothing in these Terms limits rights that cannot be waived under applicable law.

4. Accounts; Security

You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials.You agree to provide accurate, complete, and current information and to keep it updated. We may suspend or terminate accounts for suspected fraud, misuse, or violation of these Terms.

5. License and Acceptable Use

5.1 Limited license. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and Content for your personal, non-commercial educational use, subject to these Terms.

5.2 Restrictions. You must not, and must not allow others to:

  • copy, reproduce, distribute, publicly display, sell, lease, sublicense, or commercially exploit any portion of the Service or Content
  • share logins or allow multiple users to access a single user subscription unless we expressly permit it
  • scrape, crawl, harvest, or use automated means to access the Service except standard browser behavior
  • reverse engineer, decompile, disassemble, or attempt to discover source code or underlying systems, except to the extent prohibited by law
  • remove or alter proprietary notices
  • bypass or disable security or access controls
  • use the Service to build or improve a competing product, dataset, or question bank
We may enforce technical limits such as rate limiting and usage monitoring to prevent abuse.

6. Educational Content; No Guarantee; No Affiliation

The Service provides SAT preparation materials, practice questions, diagnostics, explanations, analytics, and related content for informational and educational purposes only.We do not guarantee any SAT score, score improvement, admission outcome, or result. Individual results vary and depend on factors outside our control, including prior knowledge, study habits, test day conditions, and changes to official exams. Failure to achieve any desired outcome does not constitute a breach of these Terms and does not entitle you to any refund, credit, or damages.The SAT is a trademark of the College Board. The Company is not affiliated with, endorsed by, or sponsored by the College Board.

7. Disclaimers

To the maximum extent permitted by applicable law, the Service and Content are provided "as is" and "as available."We disclaim all warranties and conditions, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement.We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any Content is accurate, complete, or up to date.Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

8. Payments, Subscriptions, Auto-Renewal, and Taxes

Certain parts of the Service require payment. By purchasing a subscription, you agree to pay the fees displayed at checkout.Subscriptions automatically renew at the cadence shown at checkout (for example monthly or annually) unless you cancel before renewal. By completing your purchase, you authorize the Company and its payment processors to charge your payment method on a recurring basis until you cancel.If you start a free or discounted trial, you will be charged automatically when the trial ends unless you cancel before the trial end date.We may change prices for future billing periods with notice as required by applicable law. Taxes may be added where required.

9. Cancellation and Refunds

9.1 Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your then-current billing period unless applicable law requires otherwise. Until that date, you retain access to paid features.

9.2 No refunds, except where required by law. All fees are final and non-refundable, and we do not provide credits or prorated amounts for partial use, non-use, dissatisfaction, or lack of results, except where required by applicable law.

9.3 Limited exceptions. We may consider a refund only in these limited situations:

  • duplicate charges for the same period, or
  • a Service-side technical failure that prevented access to paid features for the majority of a paid period, if you submit a written request within fourteen (14) days after the end of that paid period with supporting information
If we issue a refund, it may be issued as account credit or to the original payment method, at our discretion, and will be limited to the affected period.

9.4 Non-waivable rights. Nothing in these Terms limits rights that cannot be waived under applicable law.

10. 150 Point Improvement Program for SAT

This Section describes an optional program with specific eligibility requirements and a limited remedy. This program does not create a general guarantee of results.

10.1 Eligibility requirements. To qualify, you must meet all requirements below:

1. Starting score range: Provide proof of an official SAT score between 1100 and 1200 dated within 30 days before your program start date.

2. Enrollment timing: Enroll in the program within 14 days of the date of that qualifying score.

3. Continuous subscription: Maintain an active paid subscription for 12 consecutive months with no gaps, chargebacks, or payment reversals.

4. Completion requirements during the 12 months:

• Complete at least 8 full-length practice tests in the Service (tests may be repeated).

• Complete at least 2,500 practice questions in the Service.

• Maintain at least 80% study plan completion in your dashboard for assigned tasks.

• Be active on the platform for at least 10 separate days per month on average over the 12 months.

5. Final official SAT: Take an official SAT within 30 days after the 12-month period ends and provide proof of your score.

6. Integrity: No account sharing, cheating, automation, scraping, or other Terms violations.

10.2 How improvement is measured. Improvement is measured from the qualifying starting score to the highest official SAT score obtained during the measurement window described above. Superscoring is not used unless we explicitly state otherwise in writing.

10.3 Remedy. If you meet all eligibility requirements and do not achieve a 150-point increase, your sole remedy is six (6) months of free access to the Service. No cash refunds are provided under this program, except where required by applicable law. To claim the remedy, you must submit your request within 14 days of receiving your official SAT score, along with required documentation.

10.4 Exclusions. This program does not apply if: you start outside the 1100 to 1200 range; you do not complete the requirements; you do not provide documentation; you violate these Terms; or the relevant score reports are not verifiable. We are not responsible for test day conditions, accommodations decisions, exam cancellations, or changes to official exams.

11. Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute without first contacting support, we may suspend or terminate your account and restrict future purchases.We may provide evidence of your acceptance of these Terms and usage history to payment processors and banks to respond to disputes.

12. Intellectual Property

The Service, Content, and all related features and functionality are owned by us or our licensors and are protected by intellectual property laws. Except for the limited license granted above, no rights are granted to you.

13. User Content (if applicable)

If you submit content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely to operate, maintain, and improve the Service.You represent and warrant you have the rights needed to submit it and that it does not violate law or third-party rights.

14. Third-Party Services and Links

The Service may link to or integrate with third-party services. We do not control third-party services and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk.

15. Termination

We may suspend or terminate access immediately if we believe you violated these Terms, used the Service fraudulently, or created risk to the Service, users, or us.Upon termination, your license ends immediately. Sections that by their nature should survive will survive, including IP, disclaimers, limitation of liability, indemnity, and dispute resolution.

16. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your use or misuse of the Service; your violation of these Terms; your violation of any law or third-party right; or your user content, if applicable.

17. Limitation of Liability

To the maximum extent permitted by applicable law: We are not liable for indirect, incidental, special, consequential, exemplary, punitive, or statutory damages, or for lost profits, lost data, loss of goodwill, or business interruption. We have no liability for failure to achieve any desired SAT score, score improvement, or educational outcome. Our total aggregate liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of: (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $100 (or equivalent), if you have not paid any amounts.Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

18. Dispute Resolution; Arbitration; Class Action Waiver (where allowed)

18.1 Informal resolution. Before filing a claim, you agree to contact support and provide a description of the issue. We will try to resolve disputes informally.

18.2 Arbitration and opt-out. If you are a resident of the United States, and to the extent permitted by law, disputes will be resolved by binding arbitration on an individual basis, except you may bring claims in small claims court if eligible. You may opt out of arbitration within 30 days of first accepting these Terms by sending an email to info@testput.com with your name, account email, and a clear statement that you opt out of arbitration.

18.3 Class action waiver. Where permitted by law, you agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative action. If any portion of this Section is found unenforceable, the remaining parts will remain in effect to the maximum extent permitted.

19. Governing Law; Venue

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law rules.If arbitration does not apply or is not enforceable, courts located in Vancouver, British Columbia will have jurisdiction, unless applicable law requires a different venue for consumers.Nothing in this section limits non-waivable rights you may have under applicable consumer protection laws.

20. Severability; No Waiver; Assignment

If any provision is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remainder will remain in effect.Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.
